Resisting an Officer with or without Violence

Many times an arresting officer will use the charge of “resisting an officer” when no other charges apply. Because of the vague nature of the law and its broad definition, this charge (much like disorderly conduct) is heavily misused. Unfortunately, because it often comes down to the defendant’s word vs. an officer’s, this charge is also harder to combat and thus presenting a good case in your defense will require good legal representation. There are two charges associated with resisting an officer. The first, covered under Florida statute 843.01, is resisting an officer with violence. This is a felony charge and carries penalties of up to five years in a state correctional facility. Even the alleged threat of violence qualifies as resisting an officer with violence. Even if the arrest is later found to be illegal, the resisting of that arrest with violence is still subject to the applicable felony charges.

The other “resisting an officer” charge, covered under Florida statute 843.02, is resisting an officer without violence. This is a misdemeanor charge and carries penalties of up to a year in the county prison.
