Violation of Probation

There are 2 broad categories for a violation of probation: technical violations or new law violations. A technical violation occurs after a person has been placed on probation by the Judge and is accused of either failing to do or complete a special condition, such as community service, or drug counseling, or violating a standard condition of probation, such as failure to report or testing positive for an illegal drug. A new law violation is exactly as the category suggests, it occurs after a person has been placed on probation by the Judge and is accused of committing a different, new criminal offense.

Violations of Probation expose the person to the same sanctions that they could have received when they were placed on probation. Thus, the charge can occur with Misdemeanors and Felonies.

One of the big problems with violations of probation is that the person being accused is often in jail and held without an opportunity to bond out.
